By commissioning me, you are agreeing to the following terms. Please read carefully before placing an order.General
Please read carefully each type of commission's description.
- Commissions are for Personal Use only unless commercial rights are purchased. (Additional fees apply depending on service.)
- My artwork may be used for personal display such as profile pictures, banners, posting on Socials with Credit, or printing for yourself, but may not be used for profit without prior agreement.
- AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs.
- I reserve the right to decline commissions outside my abilities or for subjects I will not draw.
- Communication is important. If I do not receive a response within 3 days, I will proceed and deliver the artwork as is.Payment and Fees
- All payments are upfront in full through the agreed platform.
- Payments to proposals should be paid fully within 1 week or will be declined.
- A Non-Disclosure Agreement (NDA) fee of x2 the price applies if you request that I do not post your commission publicly or use it as part of my Portfolio.
- If a Commissioner wishes to buy Commercial Use AFTER a commission, the prices will be: Streamer Commercial Use (x3 Full Price) and Merchandise Commercial Use (x3.5 Full Price)Revisions
- Revisions are only available during the sketch phase.
- FOR FULL RENDERED COMM: You receive 4 free revisions on sketch stage only. Additional revisions cost $4 each, paid before I continue. Please provide all feedback at the sketch stage.
- FOR PHOTOBOOTH: You have free revisions in final phase if I miss details or have mistakes in reference. If you want to change character outfit or pose in this phase, I WILL NOT ACCEPT THE REQUEST.
- FOR SILLY AND SUPASMOL: You have 4 free revisions on final phase. You can request changes in poses or characters references.
- Once sketches are approved, no further changes will be made unless due to an error on my part. Mistakes I made will always be corrected at no cost.Deadline and Delivery
- Commissions can be completed within 2 hours - 2 days when it is marked as WIP.
- Commissions may take up to 2 weeks depending on complexity, queue, health, school, or personal matters.
- I will keep you updated if delays occur.
- If you wish to skip the Queue and be Priority, the fee will be 10% of the price. You will have to Directly Message me or state in the Request forms(Vgen) that you wish for a Rush Fee.INTELLECTUAL PROPERTY RIGHTS
Intellectual Property Rights
I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.
I may use the artwork to:
- Promote myself and my services.
- Post on social media and in my portfolio.
Exceptions:
If an NDA was purchased, the artwork will not be posted or used for promotional purposes.Refunds
- I may cancel and refund a commission at any time.
- You may cancel before payment is made. Once payment is received, refunds are not available.
- Chargebacks are strictly prohibited.Filing a chargeback will:
- Forfeit your rights to use the artwork.
- Place you on a public blacklist (with evidence).
- Allow me to resell or reuse the artwork as I see fit.
- Result in a formal complaint against you.Commissioner Rights
You may:
- Use the artwork for personal purposes only (unless commercial rights are purchased).
- Print the art for yourself.
- Gift the art to your friends/family/partner.
- Post it on Social Media with credit to me "@erk_v0 ".
You may NOT:
- Use the artwork commercially without permission.
- Claim the artwork as your own or fail to credit me.
- Remove signatures/watermarks.
- Resell or redistribute the artwork.
- Modify the artwork without my consent.
- Use artwork purchased for Personal Use in merch, streaming, or commercial projects.Blacklist Policy
- Breaking these rules may result in a permanent public blacklist (with evidence).
- The blacklist may be shared with other artists.Final Agreement
By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.
